Welcome to Video Quality Enhancer! These Terms of Service ("Terms") govern your access to and use of the Video Quality Enhancer website (https://videoqualityenhancer.app) and the associated browser extension (collectively, the "Service").

The Service is owned and operated by Jovan Ralić (operating under the pseudonym John Weber), based in Serbia. By accessing the website, installing the extension, or purchasing a subscription, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use our Service.

1. Description of Service

Video Quality Enhancer is a browser extension designed to improve the playback quality of HTML5 videos on the web. We offer a free 3-day trial of the extension. After the trial period expires, all features are locked, and you must purchase a valid subscription through our website to unlock and continue using the extension.

2. Subscriptions and Billing

a. Free Trial: You do not need to create an account or provide payment information to start the 3-day free trial. You will not be automatically charged when the trial ends. The extension will simply lock its features until you actively choose to purchase a subscription.

b. Paid Subscriptions: To unlock the extension after the trial, you must purchase a subscription (Monthly or Yearly) and create an account on our website. All payments are securely processed through PayPal.

c. Auto-Renewal: Subscriptions automatically renew at the end of each billing cycle unless canceled. You will be billed through your connected PayPal account.

d. Managing and Canceling Your Subscription: You have full control over your subscription. You can upgrade, downgrade, or cancel your auto-renewal at any time by logging into your account dashboard on our website (or directly via your PayPal account). If you cancel your subscription, you will not be billed again, and you will retain access to the extension until the end of your currently paid billing period.

3. Refund Policy

All sales are final, and no refunds are provided.

Because we provide a fully functional, unrestricted 3-day free trial, you have ample time to test the extension, ensure it meets your expectations, and confirm that it works perfectly on your specific device and browser before making a payment. For this reason, we do not offer refunds for any subscription payments, including renewals.

Legal Waiver for Digital Content: By purchasing a subscription and gaining immediate access to the digital content and features of the Service, you expressly consent to immediate performance of the contract and acknowledge that you lose your statutory right of withdrawal or refund (including under EU/UK consumer protection laws) once the digital content is unlocked.

It is your sole responsibility to cancel your subscription via your website dashboard or PayPal before your next billing cycle if you no longer wish to use the Service.

4. License and Usage Limitations

When you purchase a subscription, we grant you a limited, non-exclusive, non-transferable, and revocable license to use the Video Quality Enhancer extension.

a. Single Device Limit: A single subscription license is valid for use on one browser extension on one device at a time. You may not share your account details or custom User ID with others. If you switch devices or reinstall your browser, you must log into your website dashboard to link your active subscription to your new extension installation, which will automatically disconnect the previous installation.

b. Prohibited Conduct: You agree not to:

  • Reverse engineer, decompile, or disassemble the extension.
  • Resell, distribute, sub-license, or share your account access.
  • Attempt to bypass, manipulate, or exploit the trial mechanism or subscription verification system.
  • Use the Service for any illegal or unauthorized purpose.

We reserve the right to suspend or terminate your account and extension access immediately, without prior notice, refund, or liability, if you breach these Terms or engage in fraudulent activity.

5. Account Security

You are responsible for safeguarding the password you use to access your website dashboard. You agree not to disclose your password to any third party. We are not liable for any loss or damage arising from your failure to protect your login credentials.

6. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. While we strive to provide a high-quality product, we do not warrant that the extension will be entirely free of bugs, or that it will work seamlessly on every single website or video player on the internet, as third-party websites frequently update their code. We disclaim all warranties, whether express or implied, including the implied warranties of merchantability and fitness for a particular purpose.

7. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Jovan Ralić (John Weber), or any associated entities, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of, or inability to access or use, the Service; or (ii) any conduct or content of any third party on the Service.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Republic of Serbia, without regard to its conflict of law provisions.

9. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
